I would pursue it from a different standpoint, as the consumer. You're being accused of violating the law (civil law for most copyright infringement--there's also criminal copyright infringement). You are then given a punishment--the termination of a legally obtained service and of a contract you willfully entered into with another party--but not for being found guilty of violating the law, but just by having been accused of violating the law. You have no right to face your accuser (who acts as judge and jury, as well) or any form of redress for this punishment. I would also argue that Internet access is indeed a utility, and is recognized as such by the Federal government (albeit in a de facto manner--for example, the Dept. of Education requires certain things to be submitted electronically, as do other state institutions)..
